TO AUDIO SHOP
Audio Shop provides services to you subject to the following terms
and conditions. If you visit or shop at Audio Shop, you accept these
terms and conditions. Please read them carefully.
YOUR PRIVACY
We will not rent or sell your name, address, email address, credit
card information or personal information to any third party without
your permission. However, we must cooperate fully should a situation
arise where we are required by law or legal process to provide information
about a customer. If you have subscribed to our newsletter or purchased
from us, we may occasionally update you via email of new listings
and special opportunities. You may unsubscribe from the newsletter
at any time by replying with the word UNSUBSCRIBE.
YOUR PRIVACY and ADVERTISING ON THIS SITE
We use third-party advertising companies to serve ads when you visit
this website. These companies may use information (not including your
name, address, email address or telephone number) about your visits
to this and other websites in order to provide advertisements about
goods and services of interest to you. Google, as a third-party vendor,
uses the DART cookie to serve ads based on your visit to this and
other sites on the Internet. You may opt out of the use of the DART
cookie by visiting the Google
ad and content network privacy policy.
CREDIT CARD SECURITY
Our order form is placed on a Secure Server. Credit Card numbers are
stored on this Secure Server until retrieved by Audio Shop. Credit
cards are not charged until your order is ready to dispatch. If you
prefer not to transmit your card number over the Internet, you may
fax or telephone us with your credit card information.
MONEY BACK GUARANTEE
We guarantee your satisfaction with all Audio Shop purchases. You
may return any item in new condition within 30 days of delivery for
a full refund of the purchase price (minus shipping and handling charges)
if you are not completely satisfied. If you paid by cheque or money
order, Audio Shop will issue you a refund cheque or money order upon
receipt of your return. If you receive a damaged or defective item,
we will promptly send you a replacement or issue you a full refund
after you have returned the damaged or defective product. You will
not be charged any additional shipping or handling fees for replacement
shipments where the items supplied have been proven defective.
RISK OF LOSS
All items purchased from Audio Shop are made pursuant to a shipment
contract. This means that the risk of loss and title for such items
pass to you upon our delivery to the carrier.
PRODUCT AVAILABILITY
Although we attempt to keep all listings and product availability
information accurate, Audio Shop cannot guarantee that a item listed
as "In Stock" will actually ship right away, as inventory can change
from day to day. We will place any such item on backorder and advise
you of this via email. Audio Shop will make every effort to get the
backordered item(s) in stock as soon as possible. If we haven't been
able to locate and ship the item(s) to you in 21 days, an order status
email will be sent to you. If for any reason we determine that a backordered
item is no longer available, we will cancel the item from your order,
notify you immediately via email, and delete the item from the Audio
Shop catalogue. We will never charge your credit card until the item(s)
are ready to depatch.
OVERSEAS
SALES
We have to process all Credit Card transactions in NZ$, the customer
is liable for differences in any quoted price versus the final transaction
charge due to exchange rate fluctuations, as billed on your credit
card account statement. Whilst we endeavour to provide the most up
to date currency conversion available, we can not be held responsible
for variations in the quoted price versus final foreign currency price.
Freight/postal charges to overseas
destinations will be quoted on our sales confirmation email that we
send to you.
ELECTRONIC COMMUNICATIONS
When you visit Audio Shop or send e-mails to us, you are communicating
with us electronically. You consent to receive communications from
us electronically. We will communicate with you by e-mail or by posting
notices on this site. You agree that all agreements, notices, disclosures
and other communications that we provide to you electronically satisfy
any legal requirement that such communications be in writing.
COPYRIGHT
All content included on this site, such as text, graphics, logos,
button icons, images, digital downloads and data is the property of
Audio Shop or its content suppliers and protected by New Zealand and
international copyright laws. The compilation of all content on this
site is the exclusive property of Audio Shop and protected by NZ and
international copyright laws. All trademarks and trade names not owned
by Audio Shop that appear on this site are the property of their respective
owners.
LICENCE AND SITE ACCESS
Audio Shop grants you a limited licence to access and make personal
use of this site and not to download (other than page caching) or
modify it, or any portion of it. This licence does not include any
resale or commercial use of this site or its contents; any collection
and use of any product listings, descriptions, or prices; any derivative
use of this site or its contents; any downloading or copying of account
information for the benefit of another merchant; or any use of data
mining, robots, or similar data gathering and extraction tools. This
site or any portion of this site may not be reproduced, duplicated,
copied, sold, resold, visited, or otherwise exploited for any commercial
purpose without express written consent of Audio Shop. You may not
frame or utilize framing techniques to enclose any trademark, logo,
or other proprietary information (including images, text, page layout,
or form) of Audio Shop without express written consent. You may not
use any meta tags or any other "hidden text". Any unauthorized use
terminates the permission or license granted by Audio Shop. You are
granted a limited, revocable, and nonexclusive right to create a hyperlink
to the home page of Audio Shop so long as the link does not portray
Audio Shop, its suppliers, or their products or services in a false,
misleading, derogatory, or otherwise offensive matter. You may not
use any Audio Shop logo or other proprietary graphic or trademark
as part of the link without express written permission.
UNDER 18's
Audio Shop does sell products to children, but it sells them to adults,
who can purchase with a credit card or other means. If you are under
18, you may use Audio Shop only with involvement of a parent or guardian.
Audio Shop reserves the right to refuse service, terminate accounts,
remove or edit content, or cancel orders in their sole discretion.
REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER
CONTENT
Visitors may submit suggestions, ideas, comments, questions, or other
information, so long as the content is not illegal, obscene, threatening,
defamatory, invasive of privacy, infringing of intellectual property
rights, or otherwise injurious to third parties or objectionable and
does not consist of or contain software viruses, political campaigning,
commercial solicitation, chain letters, mass mailings, or any form
of "spam." You may not use a false e-mail address, impersonate any
person or entity, or otherwise mislead as to the origin of a comment
or other information, including but not limted to credit card details.
PRODUCT DESCRIPTIONS
Audio Shop attempts to be as accurate as possible. However, Audio
Shop does not warrant that product descriptions or other content of
this site is accurate, complete, reliable, current, or error-free.
If a product offered by Audio Shop itself is not as described, your
sole remedy is to return it in unused condition.
OTHER BUSINESSES
Audio Shop does not assume any responsibility or liability for the
actions, product, and content of any of our supplier or other third
parties.

LIABILITY

available" basis. Audio Shop makes no representations or warranties
of any kind, expressed or implied, as to the operation of this site

site. You expressly agree that your use of this site is at your sole
risk. To the full extent permissible by applicable law, Audio Shop
disclaims all warranties, expressed or implied, including but not
limited to, implied warranties of merchantability and fitness for

it's servers, or email sent from Audio Shop are free of viruses or
other harmful components. Audio Shop will not be liable for any damages

limited to direct, indirect, incidental, punitive and consequential

By visiting Audio Shop, you agree that the laws of the country of
New Zealand, without regard to principles of conflict of laws, will
govern these Conditions of Use and any dispute of any sort that might
arise between you and Audio Shop.
SITE POLICIES, MODIFICATION, AND SEVERABILITY
We reserve the right to make changes to our site, policies, and these
Conditions of Use at any time. If any of these conditions shall be
deemed invalid, void, or for any reason unenforceable, that condition
